PLAINTIFF IN MOTOR VEHICLE ACCIDENT RECEIVES $900,000.00 SETTLEMENT FOR CERVICAL & THORACIC SURGERIES

Hillsborough, N.J. On May 23, 2019, Plaintiff, Thomas Fino, received the proceeds of a $900,000.00 settlement for injuries he sustained in a motor vehicle accident, which occurred on October 14, 2016. The case was brought in Middlesex County and was settled by the parties just prior to a trial date of May 13, 2019.  

Mr. Fino was stopped in traffic on Spring Valley Road in Old Bridge, N.J. when he was rear ended by a motor vehicle operated by Defendant, Ryan Plante.  At the time of the accident, Mr. Fino was receiving regular chiropractic treatment for cervical and lumbar complaints. However, he was able to participate in all of his normal activities of daily living.  As a result of the impact, Mr. Fino experienced pain and weakness down his right arm that eventually necessitated anterior cervical discectomy and fusion, which was performed on March 3, 2017. Mr. Fino was progressing well after the surgery.  However, he attempted to lift a 60 pound box on Christmas Eve of 2017, and felt immediate pain in his neck left shoulder. As a result, he subsequently underwent a posterior decompression at T1-T2 on May 7, 2018.  

Plaintiff’s Neurosurgical expert, Dr. Sanford Fineman opined that Mr. Fino suffered an aggravation of pre-existing spondylosis with compression at multiple levels of his cervical and thoracic spine.  Defendant’s medical expert, Andrew Hutter opined that Mr. Fino’s symptoms and findings were pre-existing and not caused by the subject accident.
